PIERSACK v. BELGIUM
Auszug aus EGMR, 22.04.1994 - 15651/89
The instant case differs from the Piersack v. Belgium case (judgment of 1 October 1982, Series A no. 53) and the De Cubber v. Belgium case (judgment of 26 October 1984, Series A no. 86) in the nature of the duties performed by the judges who sat in those cases before the trial of the merits. - EGMR, 26.10.1984 - 9186/80
DE CUBBER v.
- EGMR, 24.05.1989 - 10486/83
HAUSCHILDT c. DANEMARK
Auszug aus EGMR, 22.04.1994 - 15651/89
What matters is the scope and nature of the measures taken by the judge before the trial (see the Hauschildt v. Denmark judgment of 24 May 1989, Series A no. 154, p. 21, para. 49, and the Nortier v. the Netherlands judgment of 24 August 1993, Series A no. 267, p. 15, para. 33).
- EGMR, 24.02.1993 - 14396/88
FEY v. AUSTRIA
Auszug aus EGMR, 22.04.1994 - 15651/89
1 (art. 6-1) must be determined according to a subjective test, that is on the basis of the personal conviction of a particular judge in a given case, and also according to an objective test, that is ascertaining whether the judge offered guarantees sufficient to exclude any legitimate doubt in this respect (see, among other authorities, the Fey v. Austria judgment of 24 February 1993, Series A no. 255-A, p. 12, para. 28). - EGMR, 26.02.1993 - 13396/87
PADOVANI v. ITALY
Auszug aus EGMR, 22.04.1994 - 15651/89
What is decisive is whether this fear can be held to be objectively justified (ibid., p. 12, para. 30, and the Padovani v. Italy judgment of 26 February 1993, Series A no. 257-B, p. 20, para. 27). - EGMR, 24.08.1993 - 13924/88
NORTIER c. PAYS-BAS
267, p. 15, para. 33).

50; Nortier ./. Niederlande, Urteil vom 24. August 1993, Serie A Bd. 267, S. 15, Randnr. 33; Saraiva de Carvalho ./. Portugal, Urteil vom 22. April 1994, Serie A Bd. 286-B, S. 38, Randnr. 35). - EGMR, 26.09.1995 - 18160/91
DIENNET v. FRANCE
The Court is thus extending - without explanation - to disciplinary bodies a trend that is fairly recent in its case-law (see the following judgments: Fey v. Austria of 24 February 1993, Series A no. 255-A, p. 12, para. 30; Padovani v. Italy of 26 February 1993, Series A no. 257-B, p. 20, para. 27; Nortier v. the Netherlands of 24 August 1993, Series A no. 267, pp. 15-16, paras. 31-37, with my concurring opinion, pp. 18-19; and Saraiva de Carvalho v. Portugal of 22 April 1994, Series A no. 286-B) and is difficult enough as it is to reconcile with the earlier case-law as set forth in the Piersack, De Cubber, Hauschildt and Thorgeir Thorgeirson judgments previously cited. - EGMR, 22.02.1996 - 17358/90

Februar 1993, Serie A Band 255-A, S. 12, Rdnr. 28; Saraiva de Carvalho ./. Portugal , Urteil vom 22. April 1994, Serie A Band 286-B, S. 38, Rdnr. 33;… und Morel ./. MOREL c. FRANCE
What is important is for that analysis to be carried out when judgment is delivered and to be based on the evidence produced and argument heard at the hearing (see, among other authorities, mutatis mutandis, the Hauschildt v. Denmark judgment of 24 May 1989, Series A no. 154, p. 22, § 50; the Nortier v. the Netherlands judgment of 24 August 1993, Series A no. 267, p. 15, § 33; and the Saraiva de Carvalho v. Portugal judgment of 22 April 1994, Series A no. 286-B, p. 38, § 35). - EGMR, 24.06.2010 - 22349/06
MANCEL ET BRANQUART c. FRANCE
Portugal, 22 avril 1994 § 38, série A no 286-B et Morel c. France, no 34130/96 § 47, CEDH 2000-IV).
- EGMR, 24.01.2002 - 40028/98
- EGMR, 09.11.2006 - 65411/01
SACILOR LORMINES c. FRANCE
Similarly, the Court has held with equal consistency that a judge's final analysis in a given case is carried out when judgment is delivered and is based on the evidence produced and argument heard at the hearing (see, for example, Hauschildt v. Denmark, judgment of 24 May 1989, Series A no. 154, § 50; Nortier v. the Netherlands, judgment of 24 August 1993, Series A no. 267, § 332; Saraiva de Carvalho v. Portugal, judgment of 22 April 1994, Series A no. 286-B, § 35; and Morel, cited above, § 45). - EGMR, 31.10.2017 - 147/07
KAMENOS v. CYPRUS
- EGMR, 23.04.1996 - 16839/90
REMLI c. FRANCE
27). - EGMR, 26.07.2001 - 33977/96
